FasterNode Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the FasterNode boilerplate code product(s) (the "Product") offered by FasterNode ("we", "us", or "our"). Please read these Terms carefully before using the Product. By accessing or using the Product, you agree to be bound by these Terms. If you disagree with any part of these Terms, then you may not access or use the Product.

1. Acceptance of Terms

By using BlackCube Cloud, you agree to be bound by these terms and conditions. If you disagree with any part of these terms, you may not use our service.

2. License Grant

• 2.1. We grant you a non-exclusive, non-transferable license to access and use the Product for your personal or commercial projects.
• 2.2. You may not modify, derivative works, reverse engineer, decompile, disassemble, or attempt to discover the source code of the Product, except as expressly permitted by applicable law.
• 2.3. You may not sublicense, distribute, sell, lease, or otherwise make the Product available to any third party.

3. Intellectual Property

• 3.1. The Product and all intellectual property rights associated therewith (including copyrights, trademarks, patents, and trade secrets) are and shall remain the sole property of FasterNode.
• 3.2. You agree not to remove or alter any copyright notices or other proprietary markings contained within the Product.

4. Disclaimer of Warranties

• 4.1. THE PRODUCT IS PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. FASTERNODE DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• 4.2. FASTERNODE DOES NOT WARRANT THAT THE PRODUCT WILL FUNCTION WITHOUT INTERRUPTION, ERROR-FREE, OR VIRUS-FREE. FASTERNODE DOES NOT WARRANT THAT THE PRODUCT WILL MEET YOUR SPECIFIC REQUIREMENTS.

5. Prohibited Activities

5.1. Users agree not to use FasterNode for any unlawful, harmful, or prohibited activities, including but not limited to:

• Violating the privacy or rights of others.
• Attempting to gain unauthorized access to the service or its users' accounts.

6. Limitation of Liability

• 6.1. IN NO EVENT SHALL FASTERNODE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE PRODUCT, EVEN IF FASTERNODE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. Changes to Terms and Conditions

• 7.1. These Terms shall remain in full force and effect until terminated by you or FasterNode.
• 7.2. We may terminate these Terms at any time without notice for any reason.
• 7.3. Upon termination of these Terms, your right to access and use the Product will immediately cease.

8. Governing Law

• 8.1. These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.

9. Entire Agreement

• 9.1. These Terms constitute the entire agreement between you and FasterNode with respect to the Product and supersede all prior or contemporaneous communications and proposals, whether oral or written.

10. Amendments

• 10.1. We reserve the right to modify these Terms at any time by posting the revised Terms on our website.
• 10.2. You are expected to check this page periodically so you are aware of any changes, as they are binding on you.
• 10.3. Your continued use of the Product after the revised Terms are posted constitutes your acceptance of the revised Terms.
